Dumbest Lawsuit Yet – Man sues Apple over iPhone “bricking”

jobs.jpg

This is one of those stories I glanced by yesterday, and just completely missed. This is phenomenally stupid. A California man has filed a class action lawsuit against Apple over bricking iPhones with their new software update…which, of course, there have been no confirmed reports of actually happening.

Think about that…this man is trying to start a class action lawsuit against Apple for the company not supporting illegal software. That’s amazing. It literally blows my mind what people are willing to waste money on these days. Does this guy think anybody but his lawyers are EVER going to see a nickel from this completely idiotic waste of time?

I don’t know. I almost feels sorry for the guy. He is getting taken to the cleaners.

  1. few days ago about that I posted:

…. Now, our recommendation. Read carefully:
You should do your due diligence before you sign up with an attorney.
Who are these two crack lawyers who want to take on Apple?
    – Damian Rene Fernandez is a construction lawyer and real estate broker from Saratoga, member of the State Bar of California since 2000.
    – Maurits Van Smith, currently is suspended, failed to pay Bar member fees of the State Bar of California since 1999, so he is not eligible to practice law.
Are these two the dream team who can take on Apple for you?
Please use your iPhone according to EULA and don’t sign up with these two opportunists phenomena. ….

  2. The best part is the terms of the class action (at appleiphonelawsuit.com). One is “5. You incurred roaming charges while traveling abroad with your iPhone.”

What the hell? They’re going to sue Apple because they knowingly took and used their phone outside their calling area? These guys are worse than bottom feeders.

  3. I realize this lawsuit looks really stupid, but just by filing it the lawyers will make a ton of money. It’s a pretty simple math equation:

    800,000 iphone buyers

~$25 in settlement per person, probably in the form of a gift certificate (cheaper for Apple to settle rather than pay lawyers to go through litigation)

33% of $25 per person x 800,000 = $6.6 million dollars in attorney fees to the lawyer

This is how law school screws with your brain.

Having said that, I LOVE my iPhone and would opt out of a class action such as this on whatever principles I have left…
